We have the Argentinean Legal Digest. The National Congress has approved the law establishing it.

After 15 years of hard work and studies, combined with persistance, determination, expertise, effort, the adequate methodology, contributions from science and academia, society and the State, we have together managed to create this major, important and useful work for the good of Argentinean society and Argentineans.

Contemporary societies need, and occasionally demand, to a greater and lesser degree according to their context and evolution, a certain legal order, or at least acceptable levels of disorder, to be able to fulfill their social purposes of welfare, peaceful development and justice.

Argentina saw this need and solved it by giving birth to a shared project for the whole of society which today culminated with this decision.

In November 2011, almost three years ago, I published an article entitled: El Digesto Jurídico. Un camino hacia la democratización de la información jurídica. [The Legal Digest. A road to democratizing legal information.] (1) in La Ley [The Law] magazine. I did so to try and answer the innumerable questions that keep coming up every time the idea of ordering the legislature and the Digest is raised, and it’s highly probable that these questions are today imbued in the minds of our colleagues and look for the following answers.

Is it necessary? Is it justified? Is it useful? For whom? Is it worth carrying out such a difficult task, a project that always involves years of hard work? Does the end justify the cost? Is it advisable given the state of the regulatory systems? Who should do it?

My intention at that time, as director responsible for that task, was to express, as clearly as possible for my colleagues and any Argentinean citizen – the first and final person for whom this work was carried out – the transcendence of this work for our social and individual well-being and for that of our institutions.

Like these words, those lines are supported by the certainty that it is an absolutely necessary task, a wish to provide the most precise information possible about its scope, to account for the implications and effects that will be felt by normal citizens in their every day lives, as of this updating of the basic rules that govern us and give the ethical reasons that justify it being carried out or that make it a central and inescapable obligation for democratic States.

Tenemos el Digesto Jurídico Argentino. El Congreso de la Nación ha sancionado la Ley que así lo consagra.

Luego de 15 años de esforzados trabajos y estudios; de la conjunción de la constancia, la decisión, el conocimiento, el esfuerzo, la metodología adecuada, los aportes de la ciencia y de la academia, de los estamentos del Estado y de la sociedad argentina, hemos logrado, juntos, dar vida a esta magna, significativa y útil obra, para la salud social e individual de los argentinos.

Las sociedades modernas necesitan, y algunas veces reclaman, con mayor o menor énfasis, según las circunstancias de su contexto y evolución, un cierto orden legislativo o al menos, un desorden aceptable, para poder cumplir sus fines sociales de bienestar, desarrollo en paz y justicia.

La Argentina se planteó dicha necesidad y la resolvió, dando vida a un Proyecto común de la sociedad toda, que hoy culmina con aquella sanción.

En Noviembre de 2011, hace casi tres años, publiqué en la revista La Ley, un artículo que denominé : El Digesto Jurídico. Un camino hacia la democratización de la información jurídica. (1)

Lo hice con la intención de dar respuesta a un sinnúmero de preguntas que se repiten, toda vez que se plantea la idea del ordenamiento legislativo y del Digesto, y es muy probable que hoy esos interrogantes se encuentren instalados en las mentes de nuestros colegas y busquen esas respuestas.

¿Es necesario hacerlo? ¿Se justifica? ¿Es una tarea útil? ¿Para quienes? ¿Vale la pena realizar una tarea tan difícil, un proyecto que siempre implica años de duro trabajo? ¿El fin justificará el costo? ¿El estado de los sistemas normativos aconseja hacerlo? ¿Quién debe hacerlo?

Mi intención en aquél momento, desde mi lugar de Director responsable de la tarea, fue poder expresar, con toda la claridad a mi alcance, – para que pudiese ser entendida por mis colegas, pero también por cualquier ciudadano argentino, primer y último destinatario de ese esfuerzo-, la trascendencia de esta obra, para aquella salud social e individual de nosotros los argentinos y de nuestras instituciones.

Aquellas líneas, como estas, están sustentadas en la certeza de que es absolutamente necesario el hacerlo, el brindar una información lo más precisa posible acerca de sus alcances, el dar cuenta de las implicancias y efectos que se verificarán en la vida cotidiana de los habitantes de nuestra sociedad, a partir de esta puesta al día de las reglas básicas que nos rigen y el dar las razones éticas que justifican su elaboración y que lo transforman en una obligación- central e ineludible- para los Estados democráticos.
